Yakub Memon: What the Media Suppresses
On 15 July 2015, across many media channels in India, we saw something that was never seen before, but which is sure to become more frequent and shriller with each passing year now: that was the reaction of Muslim leaders of various political parties to the news of the possible hanging of Yakub Memon, sentenced to death by the apex court for his role in the Mumbai blasts of ’93 which killed about 300 persons.
From the reactions of these Muslim leaders, the only possible conclusions are these:
1. Terrorists do have a religion.
2. The Muslim leaders in the TV studios could, with the straight face, make the claim which could only imply that all coreligionists of terrorists support terrorists and would be angry if terrorists are punished. That is, we should not try terrorists in the courts of law but should hold referendums to decide whether they are to be punished or not, and that too only among the coreligionists of the terrorists.
3. These Muslim leaders essentially said that Yakub Memon must not be hanged because those responsible for the riots of ’93 in Mumbai have also not been punished. That is, he acted to avenge the riots, because the State failed to act against the rioters, and since he was only avenging a crime against Muslims, he must not be punished. In short, Yakub Memon is a vigilante for a just cause, and vigilante justice is acceptable, and if a perceived wrong has been avenged by an individual or a group of individuals, it is not a crime and avenger cannot be punished.
4. If terrorists kill you, you must keep quiet, because otherwise their coreligionists will become angry and will embark on more killing sprees.
5. In a secular country, the law has to take into account the religion of the accused, and the religion of his victims, and also has to take into account the past actions of the members of the religion of the victims against the members of the religion of the terrorists.
This is flagrant talk of a tribal justice system: vigilantism, collective punishment, revenge killings outside law, and collective guilt.
Only a sick society with a death wish, and one that has lost the sense of right and wrong and what it means to be a society with rule of law, can allow such gutter talk in its news TV studios and other media.
Such talk is also the most direct call and encouragement that is publicly possible, to commit even more acts of terror till people finally submit to terror. Again, only a society too stupid to survive can allow the broadcast of such direct calls to terror through its mainstream media.
Mumbai Blasts of 1993
As far as action in the cases of the ’93 Mumbai riots is concerned, it is a sad fact of life that a riot by nature is the crime in which identification of the culprits, gathering evidence against them, and prosecuting the culprits are all very difficult. All over the world, conviction rate in cases of riots is the lowest of all crimes. Even in India, beginning with the Direct Action Day of 16 August 1946, partition riots of 1947, and all subsequent riots, conviction rates have not been better than ’93 Mumbai riots.
Above and beyond all this is the fact that no society that wishes to have rule of law and wants to survive as a civilised society, can in any way permit or condone vigilantism. Once a society starts condoning vigilantism, peace is impossible to achieve, because then every citizen is a potential prosecutor, judge, and executioner. Once this comes to prevail, the jungle raj takes over, and peace and order are impossible to achieve.
The fact is that what these Muslim leaders were saying in the TV studios, is what the Islamic doctrine preaches and practices: if kafirs have harmed Muslims anywhere, each and every Muslim gets the right to avenge the harm, and can not be punished for doing so. This is the clear position of the sharia and the dhimma pact. So Muslim leaders were essentially saying that Yaqub Menon must be dealt with in accordance with sharia, and not as per Indian Penal Code.
This was unimaginable even a decade ago: that Muslim leaders would so openly demand sharia supremacy over Indian law. Our secularists used to demand mercy for the terrorists on various grounds, but Muslim leaders themselves always kept quiet. Strategic silence.
So what has changed?

Islam’s law of numbers has come into the picture. It says that if Muslims are in hopeless minority in a place, they can feign to be secular, and agree to live under secular law, but as soon as they gain the numbers, they have to live according to sharia, and as their numbers grow further, they have to impose sharia on everybody, using violence, if required. If this is the situation when the ratio is just 16 per cent Muslims to 78 per cent Hindus, we can easily imagine what would be the situation when the ratio becomes 20:70, 25:65, 35:55 in favour of Muslims. unless the truly nationalist elements among all religions in India come together and defeat the fascist forces, work for the brotherhood among all communities, foster freedom, liberty, equality and democracy resulting in rule of law as mandated by the constitution of India, unless the rule of law is applied and enforced against everyone without discrimination, unless unjust and unfair laws are revoked and more just laws made, unless we give up the evil planted in most of us in India and Pakistan and Bangladesh by the British colonialism and imperialism and nurtured Even after their departure by their demonic children of the civil and military services and political and fascist forces created and nurtured by the British, there is never going to be a solution to the communal conflict conundrum in India.

In South Asia we are unable to recognize this phenomenon of a neo Hindu fascism, a neo Muslim fascism.
Because the rest of the world is unable to see the fascist nature of ISIS N TALIBAN, they also appear to be unable to see that nature in South Asia, Maldives etc.
One reason why the west does not want to see or acknowledge the fascist nature of ISIS etc could be the dramatic attention it could draw to the details of History of the original fascist thought and action propounded by shri Adolf Hitler and company. Their actions of extermination of the Jewish community and war against the world nations, the coming together of the axis nations of Italy, Germany and Japan, Franco of Spain etc, apart from early supporters and practitioners of fascist philosophy and politics in Britain who took out many a rally in London with full support of the then London police who supported the English fascists and let loose a reign of terror against the English anti fascists, the only people who protested fascism politically. These good people were branded communist, whether they were communist or not politically.
And great Britain soon started paying the price with shri Adolf Hitler Maharaj directly attacking Britain and British Empire! Then the war against fascism began.
Many countries in Europe have been witnessing a resurgence of fascism in the last decade and more. The fascist elements are emerging as third forces in most of these countries which till now had only conservatives and liberals or social democratic parties. And the extreme rightist in the conservative parties are openly adopting fascist thought and action, racism. Britain is witnessing so many anti democratic laws and racist immigration policies.
So these European countries and their big brother, even Canada, Australia which too are facing the onslaught of emerging neo fascist thought, are reluctant to acknowledge the phenomenon of emerging fascism. The rise of militarism in Japan, the Japanese challenge to China for keeping the fruits of gains in second world War it made before being defeated and the new axis Japan is trying to form with EEC, Australia, Philippines, India etc are signs of this new trend. So any acknowledgement of the emerging fascism will bring all these developments in question.
THE divisions wrought between the Hindu and Muslim communities by the British using the Hindu and Muslim zamindars, the colonial administration of ICS, IPS, IFS officers led to the formation of Pakistan by breaking up India. Yet there wouldn’t have been any issues between India and Pakistan if only the Kashmir issue did not emerge between these two countries. Had not that fool of a royal hireling called Mountbatten, the first governor general of India after the transfer of power, remember it was no independence in the real sense, fumbled and tumbled and wrought himself, the jammu and Kashmir, India and Pakistan into knots, both these countries could have prospered, may be with some welcome competition but without any wars and hatred and terrorism.
If only had that fool, and shri pandit jawahar lal Nehru that had a soft corner and some relationship with the family and back ground of this fool of an earlier viceroy and later Governor-General, exercised a little wisdom, a little caution, a little political acumen and brought Britain down to a conference table, along with Maharaja Hari Singh and India and Pakistan, got in place a proper and transparent instrument of Accession or whatever, there would only have been peace and harmony. Other than the Accession of the jammu and Kashmir into India, there have never been any issues between these two brotherly countries which were together as one large family for hundreds of years, which contributed hundreds of thousands of soldiers in the fight against fascism. Neither India nor Pakistan had any power or guts to push each other or Britain at a conference table.
But these two unfortunate characters, unfortunate for India and Pakistan and jammu and Kashmir and the people of the world, hurrying down egged by the colonial administration using the same non transparent colonial and imperialist cunning and stratagem, secrete signatures, secrete documents, manipulation of the rogue and mutually competitive colonial ICS and IFS officers, there was nothing for India and Pakistan to fight for.
As part of the British and zamindars of Hindu and Muslim tag, their conspiracy to use one minority community in one area against the majority community there, for Hindus and Muslims were in majority and minority in different areas before the partition of India, the fascist elements among the two communities emerged, emboldened and Consolidated in India and Pakistan. Pakistan got fully polarised, sent out most Hindus that didn’t shift during migration. But in India there were almost as many as half of then United Pakistan population who were Muslims that chose to continue to be part of India. Most of fascist or potential fascists of Muslim community got contained in Pakistan and very few were left behind, as all those who choose to be in India were those who did not chose to migrate to Pakistan side, either the East Pakistan, which is now Bangladesh, or to the west Pakistan. But all the Hindu fascists continued to be in India. Many were concentrated in maharashtra, as the plight of changing times wrought many a suffering on the brahmin community in maharashtra and some emerging motivated people chose to adopt fascist philosophy to bring the lost glory back to the community. Some went on a tour of Italy and Germany, closely observed the philosophy and practice of newly emerging fascism that was then a very heroic and novel new philosophy that was also quite fashionable in those countries, studied their organisational structures and practices, the storm troopers and returned to India to form their own Indian outfits. And they succee. And now we have an India that the fascists of both communities want to divide and rule.
Most wise leaders of Congress, the third front and the bjp who grew above the pygmies in their respective parties realised this. Their counter parts in Pakistan realised this. That is how the political leaderships in India and Pakistan have agreed and concluded the only possible and plausible solution to the jammu and Kashmir conundrum!
That is each one, india and Pakistan keeps what they have. About two thirds of the state of jammu and Kashmir is now part of India. About the balance of one third is part of Pakistan. No doubt some people will raise the question of azad Kashmir or an independent country of Kashmir. But once India and Pakistan sort out the issue between themselves, these forces will slowly loose credibility for any scessionism politics and will be happy with more or less of the terms of the instrument of Accession and the constitution of jammu and Kashmir. Not less because the international law does not permit breach of any of those conditions in the instrument of Accession or the Constitution of jammu and Kashmir. Once the Kashmir people begin enjoying their relative autonomy in peace and harmony, issues like that of pundits etc can be smoothly settled and they get their justice and fair share for resettlement where they were or newer places where needed.
Once the Kashmir issue is over there will be lasting peace and harmony between India and Pakistan. There will be lasting peace between the communities in India. The role of Hindu and Muslim fascism will progressively diminish. New and neutral forces will emerge among Muslim community in India. Even today most of the Hindu community is neutral and non fascist. It is just that a few are able to fool people in different guises and keep fascist thought on the fore but without success.
A similar solution with China too is possible, as former Navy chief shri Ramdoss suggested, which again was accepted between Indian and Chinese leadership many a time, keep what each has with mutually agreeable adjustments.
Nothing else works between nuclear armed nations. No forcible change of borders is ever possible. The story of Bangladesh can not repeat.
Nor can the declaration of national emergency.
Once this is achieved, the whole of Asia will be integrated with the mighty Europe.
Undemocratic, fascist, racist forces, forces of aggression and expansionism, forces of terrorism, forces of obscruitinism will weaken everywhere.
Forces of peace and progress will ascend high.

Whatever the guilt of Muslim murderers, India betrays its heritage not only by having a death penalty, but by doing it in such a barbaric way, the medieval & British colonial hanging method which in fact is often slow strangulation, taking as much as an hour for the victim to die.
A glorious forgotten fact of India’s heritage … It was in India FIRST that sovereign states abolished the death penalty, well over 1200 years ago (over 2000 by some accounts) … As dharma religions spread by their lustre, scholars from across Asia studying at Nalanda, Buddhist Japan and Daoist China, followed the example of states in India, and at points abolished the death penalty too … all a millienium before the ‘Western Enlightenment’ abolitions of the 1800s began to occur!
Hanging is always slow strangulation, taking 15 minutes to an hour for the person to die – although sometimes the neck is broken in a drop mercifully introducing coma – but this is not reliable and often fails to happen, creating an hour of torture as a human being swings on a rope. And it takes longer for smaller people to die … amid the many hangings in Iran, witnesses observe that the women struggle longer, strangling to death slowly before the crowd.
Tho grim to bystanders, the most merciful methods of death penalty are beheading or the bullet – this is fact. The USA has shown that lethal injection sometimes is an hour-plus torture ordeal. Other killing methods also have gone terribly wrong. Beheading is a mercy, as is a bullet to the back of the head, or the firing squad (best with a handgun back-up for a coup de grace if the firing squad are off-target).
If India feels as if too poor a country to yet dispense with the death penalty … at least it should dispense with the British colonialist torture-hanging horror. Bullets or beheading would be a merciful improvement … but I pray that India will move to an even higher level, in line with its glorious ancient past.
Europe is now death-penalty-free in line with India’s dharma heritage passed on through the stoics to Europe’s enlightenment. In old Europe, hanging was the torture-method for commoners, beheading was the merciful method for aristocrats. This is why the French revolution introduced the guillotine … giving all citizens executed the quick, merciful death once reserved to aristocrats and beneficiaries of a monarch’s favours.
You are wrong. You don’t die ONLY of strangulation when you are hanged. The fall causes your cervical spine to snap and death is more or less instantaneous. I am all for death penalty for terrorist acts, pedophile violation of innocent children,violent rape and murder of women. Deterrent is a useful weapon. What are you talking here about ancient Hindu dharma? Shri Krishna did not exactly ask Arjuna to put down his weapons and go on dharna or fast to death like the egocentric Gandhi fella used to do. Adharma need to be defeated, even if it means taking lives. Ahimsa does not mean non injury. It means least harm to protect Dharma

Good points ! To add Muslims think that offense is the best form of defense ! This is the direct result of the Middle East strife and their frustration loosing the “Clash of civilizations” with the west ! They now want to take the battle to every Non-Muslim country !
